    Legal Metrology - Overview

    Weights and measurement standards are established and upheld under the Legal Metrology Registration Act. Because it mandates registration and additional compliance for packers, dealers, and particularly eCommerce businesses dealing with packaged goods, the main legislation governing packaged goods, along with rules pertaining to various topics like national standards, model approvals, and numeration, has a broad impact.

    To uphold moral corporate practices and protect customers’ rights, the Act establishes regulations for product packaging. It also establishes the maximum sizes and weights for packaged goods. The Act also specifies the disclosure, conditions, and methods. The administration of the Act is carried out by the department of legal metrology, a division of the department of consumer affairs, in each state.

    Mandatory Information

    • Manufacturer, Importer, and Packer Information
    • The name and address of the producing, packaging, or importing organisation must be listed on packaged goods
    • If the production and packaging companies' names and addresses are different, they must be declared separately. This rule does not apply to food products because they are protected by the Food Safety and Security Act
    • The product being offered is under a generic name
    • List the highest possible retail price (including all taxes)
    • The packaging must include the date of manufacturing, packaging, or import as well as the month and year
    • On the product, the date of expiry should be listed along with the month and year
    • Additionally, the window of time during which the product is most effective can be indicated
    • Commodity quantity, ingredient(s), customer service or helpline for consumer complaints must be provided without fail.

    Legal Provisions Of Legal Metrology Act Registration

    Section 19 of the Act
    If a person is not registered with the Concerned Authority and does not possess a current LMPC Certification, they are not authorised to import any weights or measurements.

    Section 38
    Any person who engages in the activity of importing any weight or measure without first registering under the Act would be subject to a fine that can reach ₹ 25000 for a second or subsequent offence, as well as a term of imprisonment that can last up to six months.

    Rules Set Under Legal Metrology Act

    The Legal Metrology Act of 2009 has several rules to regulate the use of weighing and measuring devices in India. These include:

    • The Legal Metrology (General) Rules, 2011: These rules cover around 40 different types of weighing and measuring devices, including electronic weighing instruments, weighbridges, fuel pumps, water metres, sphygmomanometers, clinical thermometers, etc. The devices are checked regularly by State Government personnel using standard weights and measures as per the process outlined in the Rules.
    • The Legal Metrology (Packaged Commodities) Rules, 2011: This rule mandates certain labelling requirements for pre-packaged commodities sold in India. These include declarations such as the name and address of the manufacturer/packer/importer, the country of origin (in case of imported packages), the common or generic name of the commodity, net quantity, month and year of manufacture/pack/import, maximum retail price (inclusive of all taxes), and consumer care details.
    • The Legal Metrology (Approval of Models) Rules, 2011: This rule defines the standard measures or numbers and how pre-packaged goods shall bear affirmations and other particulars.
    • The Legal Metrology (National Standards) Rules, 2011 defines the specifications of base units of measures and base units of mass, different standards, and times of verification of the norms.
    • The Legal Metrology (Numeration) Rules, 2011: This rule specifies how numeration should be made and how numbers should be written.
    • Indian Institute of Legal Metrology Rules, 2011: These rules govern the Indian Institute of Legal Metrology, Ranchi, the training institute for Legal Metrology Officers of States/UTs/Union of India. The rules specify the courses to be communicated at the Institute, obligatory functions of the Institute, and qualifications of persons eligible for admission.
    • The Legal Metrology (Government Approved Test Centre) Rules, 2013: These rules govern the approval of Government Approved Test Centres (GATCs) created by private individuals to verify certain weights and measures by State Government Officers. The rules specify the weights and measures that can be verified by a GATC, including water metres, sphygmomanometers, clinical thermometers, automatic rail weighbridges, tape measures, non-automatic weighing instruments of accuracy class-IIII/Class-III (up to 150kg), load cell, beam scale, counter machine, and weights of all categories.
